CareWinners, LLC ("we," "us," "our") is a Virginia-based caregiving marketplace that connects families ("Clients" or "Careseekers") with independent caregivers ("Care Providers"). We are not a home-care agency or employer of caregivers. Our platform offers AI-powered matching for non-medical in-home services like senior care, childcare, personal assistance, and companionship.

This Privacy Policy explains how we collect, use, share, and protect your personal information when you use carewinners.com, our mobile apps, and related services (the "Services"). It also describes your rights under the Virginia Consumer Data Protection Act (VCDPA) and, where applicable, the California Consumer Privacy Act (CCPA/CPRA)and other U.S. state privacy laws. By using CareWinners, you accept this Policy.

We do not collect race, ethnicity, religious beliefs, sexual orientation, or precise health diagnoses unless voluntarily provided via self-identification for matching. Careseeker gender preferences are used solely for personalized matching and not for discrimination.

3. How We Use Your Information

  • Provide and improve the Services (matching, scheduling, messaging).
  • Verify identity, conduct background checks, and ensure platform safety.
  • Process payments and payouts via Stripe Connect.
  • Send transactional emails/SMS and support messages.
  • Personalize recommendations and detect fraud (including voluntary matching based on self-identified origin, gender preferences, or cultural factors with explicit consent).
  • Comply with legal obligations (FCRA, IRS reporting, VCDPA, etc.).
  • Train non-production AI/ML models for better matching (anonymized data only).

We do not sell your personal data for money and do not share it for cross-contextual behavioral advertising.

How to exercise:

We will verify and respond within 45 days (extendable once by another 45 days). Appeals must be filed within 15 days of denial.

6. Sensitive Personal Data

We process limited sensitive data (government IDs, background results, precise geolocation when GPS is on, disability accommodations, self-identified origin/ethnicity, or gender preferences you voluntarily share) only with your explicit consent or as required to provide the Services. You may withdraw consent at any time via profile settings.

7. Data Security & Breach Notification

We use encryption (TLS & at-rest), access controls, 2FA, and regular audits. In case of a data breach, we will notify affected users and the Virginia Attorney General as required by law (within 30 days for VA residents).

10. International Users

Your data will be transferred to and processed in the United States. By using the Services from outside the U.S., you consent to such transfer.

11. Changes to This Policy

We will notify you by email and in-app alert for material changes (e.g., new data types like identity preferences). We will not use new data without prior notice and opt-in. Continued use after changes constitutes acceptance.

12. Non-Discrimination

CareWinners does not discriminate based on race, national origin, gender, or other protected characteristics. Matching preferences (e.g., gender or origin) are user-driven, optional, and used solely for inclusive, personalized services.
